Terms and Conditions

General Terms

By booking services, submitting a project request, or accessing York Aero’s website, the client (“you”) agrees to these Terms and Conditions. All aerial operations are conducted in compliance with FAA Part 107 regulations and applicable federal, state, and local laws.

Services

York Aero provides professional aerial imaging, mapping, and inspection services. Specific service scopes, deliverables, and timelines are defined in written proposals, estimates, or project confirmations. York Aero reserves the right to modify, delay, or reschedule operations due to weather conditions, airspace restrictions, equipment issues, or safety considerations.

Payment Terms

A 30% deposit is required upon flight confirmation unless otherwise agreed in writing. The remaining balance is due within 15 days (Net 15) of delivery of final deliverables. Payments not received by the due date may incur a 2% monthly finance charge. Deliverables remain the property of York Aero until payment is received in full.

Cancellation and Rescheduling

Flights may be rescheduled due to weather, equipment issues, regulatory restrictions, or other safety-related factors at no additional charge.

Clients may cancel up to 48 hours prior to the scheduled operation for a refund of payments made excluding the deposit. Cancellations within 48 hours of the scheduled operation will result in forfeiture of the deposit.

Data Ownership and Usage

Upon full payment, clients are granted a non-exclusive, perpetual license to use final deliverables for marketing, documentation, reporting, and internal business purposes.

Raw imagery, source data, project files, and archives remain the intellectual property of York Aero unless otherwise agreed to in writing.

Limitation of Liability

York Aero’s total liability for any claim arising from services provided is limited to the total amount paid for the specific project. York Aero shall not be liable for indirect, incidental, or consequential damages, including but not limited to lost profits, loss of data, or business interruption.

Safety & Compliance

All flight operations are conducted by FAA-certified remote pilots in accordance with Part 107 regulations. Flights will not be conducted in restricted, unsafe, or non-compliant conditions. Clients are responsible for ensuring the site is legally accessible and free of known hazards that could impact safe flight operations.

Privacy and Data Handling

York Aero collects client information solely for scheduling, billing, communication, and service delivery purposes. Client data will not be sold or shared with third parties except as required by law or necessary to fulfill contracted services. All digital records are stored using commercially reasonable security measures.

SMS Terms of Service

By opting into SMS communications from York Aero through a web form, written agreement, or other medium, you consent to receive SMS messages related to our services.

Types of Messages

Messages may include, but are not limited to:

  • Appointment scheduling and reminders
  • Project coordination and status updates
  • Service-related notifications
  • Direct client communications related to ongoing or prospective projects

Messaging Frequency

Message frequency may vary based on project activity and communication needs.

Message & Data Rates

Message and data rates may apply depending on your mobile carrier and plan.

Opt-Out Instructions

You may opt out of SMS communications at any time by replying STOP to any message. You will receive a confirmation message and no further SMS messages will be sent unless you re-opt in.

Changes to Terms

York Aero reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on the website and apply to new projects initiated after the revision date.

Governing Law

These Terms and Conditions are governed by the laws of the State of Georgia. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Hall County, Georgia.
